Terms Of Service

These terms govern Kiyo, including the website, Kiyo Account, web chat, checkout, billing, and the chat-based accountability service delivered through supported messaging channels.

By submitting your phone number, signing in, starting a checkout, using the web chat, or sending Kiyo a message, you agree to these terms.

If you use Kiyo for an organization, you confirm that you are authorized to accept these terms for that organization.

Kiyo is an AI accountability companion. It can respond to your messages, send follow-ups, remember stable context, schedule reminders, use connected CTRL product context with your permission, and help you stay on track with goals, routines, and decisions.

Kiyo is not a human coach. Responses are generated automatically and may be incomplete, wrong, delayed, or unavailable.

You remain responsible for your choices, commitments, work, health, relationships, finances, and actions.

You are responsible for the phone number, messaging account, and CTRL Account you use with Kiyo. You must only use accounts and channels you are authorized to use.

Kiyo may support WhatsApp, web chat, and other channels depending on availability. Channel support can change.

Your mobile carrier or messaging provider may charge fees. Your carrier and other channel providers remain responsible for their own apps, transport, uptime, backups, and privacy handling.

You must keep login codes, account links, and session access secure. Tell us promptly if you believe your Kiyo access has been misused.

You may not use Kiyo for abuse, harassment, spam, illegal activity, fraud, exploitation, self-harm instructions, malware, automated attacks, prompt extraction attempts, model abuse, or anything that interferes with the service or other users.

You may not send content that you do not have the right to share, impersonate another person, bypass access controls, overload the service, scrape the service, or use Kiyo to make decisions that legally require professional judgment.

We may suspend, rate-limit, or terminate access if we reasonably believe your use is abusive, unlawful, or creates security risk.

Kiyo is not medical, psychiatric, therapeutic, legal, financial, or emergency support. Do not rely on it where professional judgment or urgent intervention is required.

If you are in crisis or need immediate help, contact qualified local professionals or emergency services instead of relying on Kiyo.

AI output can be inaccurate, incomplete, outdated, or unsuitable for your situation. You should review important output before relying on it.

Kiyo may store memory and profile context so the service stays useful over time. You can turn memory off, clear memory, and set chat retention in Kiyo Account where available.

If you ask Kiyo to remember something, schedule a reminder, use connected app context, or create a checkout link, you authorize Kiyo to process the data needed for that action.

Paid access, trials, subscriptions, discounts, and checkout links are handled through our payment processor. Payment details are collected by that processor.

The price, billing interval, trial, discount, and renewal terms shown at checkout apply to your purchase. Taxes may apply.

Unless cancelled before renewal, subscriptions may renew automatically. You can manage billing through the billing portal where available.

If a payment fails, a subscription ends, or fraud or abuse is suspected, access may be limited or suspended.

You can cancel a subscription for the future through the billing portal where available or by contacting us.

Mandatory consumer rights, including statutory withdrawal rights, remain unaffected. If a statutory withdrawal right applies, we will provide the required handling under applicable law.

If you ask us to provide a digital service immediately during a withdrawal period, the law may require consent to immediate performance and acknowledgement that the withdrawal right can expire once the service has been fully performed.

We store chat history, profile data, memory items, message routing records, billing records, product analytics, checkout events, account actions, retention signals, and related operational data to run, secure, improve, and measure the service. Details are explained in the Privacy Policy.

You can use Kiyo Account privacy controls where available or contact info@ctrl-app.studio. We may retain limited data where legally required or necessary for fraud prevention, billing, security, audit, or legal defense.

Kiyo may change, pause, or remove features at any time. We do not guarantee uninterrupted availability, channel support, or specific response times.

We may update these terms when the service changes. Continued use after an update means you accept the revised version.

Kiyo depends on third-party services for messaging, authentication, AI processing, analytics, hosting, and payments. We are not responsible for third-party services outside our control.

Your use of account, messaging, payment, and other third-party services is also governed by their own terms and privacy policies.

Kiyo, the website, brand assets, software, prompts, workflows, and product design belong to CTRL Studio or its licensors.

You keep rights to content you send. You grant us the rights needed to host, process, transmit, generate, store, display, and otherwise use that content to provide and protect Kiyo.

You may use Kiyo output for your personal or internal purposes, subject to these terms and applicable law.

We are liable without limitation for intent, gross negligence, injury to life, body, or health, and where liability is mandatory under applicable law.

In all other cases, our liability is limited to foreseeable damage typical for this type of service. You remain responsible for the decisions and actions you take based on Kiyo output.

German law applies, excluding conflict-of-law rules, to the extent legally permissible. Mandatory consumer protection law of your country of residence remains unaffected where applicable.

If you are a merchant, legal entity under public law, or special fund under public law, the courts at our registered seat have jurisdiction where legally permitted.
